The attorneys at Robinson Warncke have been handling an increasing number of claims and disputes relating to Long Term Care Insurance. Very few attorneys handle these claims, and the work is very specialized.

Long Term Care Insurance first became available in the 1960’s and 1970’s in an attempt make the cost of long term care more affordable and predictable. Long Term Care insurance typically pays a benefit to help cover the cost of most types of personal assistance and residential care, including home health care visits and/or residential care in a nursing home or assisted living facility.

Unfortunately for everyone involved, the insurance industry underpriced and oversold Long Term Care Insurance coverage for decades, resulting in billions of dollars in losses. The industry, reacting to these losses, has drastically changed the availability, cost and terms of Long Term Care Insurance over the decades.

Nowadays, long term care insurance policies are some of the most densely worded and confusing policies we encounter. We have learned through experience that there are many traps for the unwary when presenting a claim for benefits.

Attorneys Jeff Warncke and Steve Mitchell recently wrote a full-length academic paper on the topic. In October, 2022 Mr. Warncke also delivered a speech at a Continuing Legal Education seminar presented to the Elder Abuse section of the Georgia Trial Lawyer’ Association.
